Pedestrian Crash Reconstruction: Visibility, Speed, and Avoidability Analysis

Pedestrian collisions often present some of the most difficult questions in crash reconstruction.


Where did the impact occur? How fast was the vehicle traveling? When did the pedestrian become visible? How much time and distance did the driver have to respond? Could either party have taken an action that would have changed the outcome?


Answering those questions requires more than reviewing a crash report or estimating speed based on where the pedestrian came to rest. A meaningful pedestrian crash reconstruction evaluates the available physical, digital, photographic, environmental, and testimonial evidence together.


For attorneys handling serious injury or fatal pedestrian collisions, the objective is not simply to recreate what happened. The more important question is often:


What does the available evidence allow us to determine about perception, response, and avoidability?


What Evidence Matters in a Pedestrian Crash?


Pedestrian crash reconstruction begins with preservation and evaluation of the available evidence.


Depending on the case, relevant materials may include:


• Crash reports and investigative supplements

• Scene photographs and video

• Vehicle photographs and damage documentation• Roadway measurements and diagrams

• Tire marks, debris, biological evidence, and other physical evidence

• Vehicle Event Data Recorder, or EDR, information when available

• Surveillance, dash camera, body camera, or other video

• Witness and driver statements

• Pedestrian clothing and conspicuity information

• Roadway lighting and environmental conditions

• Traffic signal timing or intersection data

• Medical or autopsy documentation when relevant to the reconstruction

• 3D scans, point clouds, drone imagery, or other scene documentation


No single item necessarily answers the reconstruction question by itself. The significance comes from evaluating how the evidence fits together.


Determining the Area of Impact


One of the first reconstruction questions is often the location of the pedestrian at the time of impact.


Investigators may evaluate physical evidence such as debris, biological evidence, tire marks, vehicle damage, roadway markings, pedestrian rest position, and documented scene evidence to help identify or constrain the impact area.


This location can become critical when examining questions involving lane position, pedestrian movement, crosswalk use, driver sight lines, and available reaction distance.


Vehicle Speed and Pedestrian Movement


Vehicle speed may be evaluated using several independent or complementary methods, depending on the available evidence.


Possible sources include EDR data, video analysis, tire marks, vehicle dynamics, roadway evidence, and other reconstruction calculations.


Pedestrian throw distance can also provide information in appropriate cases, but it should not be treated as a standalone measurement of vehicle speed. Research has demonstrated a relationship between pedestrian throw distance and impact speed, while also showing that the estimate depends on collision configuration and underlying assumptions. For that reason, throw analysis is strongest when considered alongside other available evidence.


Pedestrian movement may also matter. Walking or running speed, direction of travel, and the time required for the pedestrian to enter the vehicle's path can contribute to a time and distance analysis.


Visibility Is Different From Being Present

A pedestrian may have been physically present in or near the roadway before a collision without necessarily being detectable or recognizable to a driver at that same moment.

That distinction becomes especially important in nighttime crashes.


A visibility analysis may consider:


• Ambient roadway lighting

• Vehicle headlamp illumination

• Pedestrian clothing and contrast

• Background lighting and visual clutter

• Roadway geometry

• Curves, grades, and sight restrictions

• Parked or moving vehicles

• Vegetation, signs, structures, or other obstructions

• Weather conditions

• Direction of travel

• The driver's line of sight


NHTSA has specifically recognized that visual screens, roadway conditions, and nighttime conspicuity can affect when a pedestrian becomes detectable to a motorist.


The reconstruction question, therefore, is not merely, “Was the pedestrian there?”


It may be:


“When would the pedestrian reasonably have become available for detection and recognition from the driver's position?”


Perception Response and Avoidability


Once the available sight distance and hazard development are understood, the analysis can move to perception response and avoidability.


This may involve establishing a timeline that considers:


  1. When the pedestrian entered or approached the vehicle's path

  2. When the pedestrian became available for detection

  3. The driver's speed and position at that time

  4. The distance between the vehicle and the pedestrian

  5. An appropriate perception response interval based on the circumstances

  6. Vehicle braking or steering capability

  7. Whether a collision could have been avoided or its severity reduced


Speed can be especially important because additional speed affects more than impact energy. It also changes how much roadway the vehicle travels during perception and response and increases the distance required to stop.


The analysis should distinguish between what was physically possible and what the evidence supports regarding the actual circumstances faced by the driver.


Could the Crash Have Been Avoided?


Avoidability is rarely answered appropriately by looking at one isolated number.


A reconstruction may examine different scenarios.


For example:

What would have happened if the vehicle had been traveling at a different speed?

Would the pedestrian have cleared the vehicle's path?

Would braking have prevented contact?

Would earlier recognition have changed the outcome?

Would the collision still have occurred but at a lower impact speed?


Those are time, distance, visibility, and vehicle dynamics questions that can often be evaluated objectively when sufficient evidence exists.


Importantly, a reconstructionist's role is not to determine legal fault. The technical analysis should identify what the physical evidence supports and provide attorneys with a defensible foundation for evaluating causation and the issues in dispute.


Why Early Case Review Matters


Pedestrian cases can become more difficult as evidence disappears.


Vehicles are repaired or sold. Roadways change. Surveillance video is overwritten. Lighting conditions may change. Witness memories fade. Scene evidence is removed.


An early technical review can help identify what evidence exists, what additional information should be preserved, and whether further reconstruction work is warranted.


Not every case requires a complete reconstruction.


In some matters, an initial case review may be sufficient to identify the critical technical questions and determine whether additional analysis would be useful.
